Initial Shipment-100% DLC at sight, Confirmed and Irrevocable, Non-Transferable, Operative, cash backed for the value of one month shipment valid for 90 days issued or confirmed by a top 50 bank. Payment at sight via MT103 at port of loading against shipping documents.
Thereafter by Standby Letter of Credit (SBLC), Irrevocable, Non-Transferable cash backed for one month value by a top 50 bank for a term of 365 days plus one day. Payment at sight via MT103 at port of loading against shipping documents
11. BUYER’S BANK SENDS THE SWIFT (MT760) MESSAGE (SBLC) TO BUSINESS GROUP ENTERPRISES LLC BANK
12. PERFORMANCE BOND TWO PERCENT (2%) ISSUED AFTER CONFIRMATION OF THE DLC AND THEREAFTER THE SBLC, FOR BOTH THE TRIAL AND THE CONTRACT, BY BUYER’S BANK, WITH PB TO BE REVOLVING FOR THE ENTIRE CONTRACT TERM INCLUDING ROLLS AND EXTENSIONS.
13. WITHIN 35/45 DAYS AFTER THE FINANCIAL INSTRUMENT IS OPEN, DELIVERY STARTS
14. WITHIN 3 BUSINESS DAYS AFTER RECIVING THE SHIPPING DOCUMENT, REAL PAYMENT IS RELEASED BY MT103/TT AT LOADING PORT. PAYMENT AT SIGHT VIA MT103 AT PORT OF LOADING AGAINST SHIPPING DOCUMENTS AT BUYER’S BANK.

Any other specifications which are not mentioned in the specifications are to be according to the international specifications which were fixed by (fao/who/fda/and ec) and the lowest amount should be considered first.
NON-CIRCUMVENTION AND NON-DISCLOSURE :
The BUYER acknowledges that the SELLER’S Supplier information constitutes confidential information and of exclusive property of the SELLER. The BUYER hereby irrevocably agrees not to circumvent, evade, avoid, bypass, or obviate, directly or indirectly, the intent of this Agreement.
The BUYER hereby agrees for itself, their officers, directors, partners, agents, associates, subsidiaries, affiliates, or any related parties, that will not, directly or indirectly, contact, deal with, or otherwise become involved with any of SELLER’s Supplier’s or any other entities or parties introduced, directly or indirectly, by or through the other party, its officers, directors, agents or associates.
This obligation is valid for all transactions between the parties herein, and any related parties.
A violation of this clause will constitute a breach of the contract and will result in a fine for early indemnity in the amount of 300% of the value of this Agreement in favor of the innocent party.
